In November 2010, the State of Virginia had altered the Virginia Administrative Code to alter their hospice service regulations to be in accordance with § 1905 (O) of the SSA, which states that individuals under 21 years of age may elect to receive hospice care while continuing active treatment of their terminal illness. In our search for this change, we did not come across a provider letter or announcement from a state official but were able to date this change from the historical notes on the administrative code, which is provided at the end of the code. This can be found within the Virginia Administrative Code under Title 12. Health, Agency 30. Department of Medical Assistance Services, Chapter 50. Amount, Duration, and Scope of Medical and Remedial Care Services, Section 270. Hospice Services, Part D. This can be found on the Virginia Law site at this link and at 2010_Virginia.
