In March 2011, the Maryland Department of Health and Mental Hygiene issue a Managed Care Organization Transmittal and Hospice Transmittal, which clarified the implications of Section 2302 of the Affordable Care Act (ACA). The transmittal explained that the prohbition on children receiving curative treatment upon the election of hospice care had been lifted and cited the guidelines which were released by the Centers for Medicaid and Medicaid Services (CMS) in September of 2010. The transmittal emphasized that all Medicaid managed care organizations (MCOs) and hospice providers must ensure all appropriate staff in their organizations must be made aware of this change. The transmittal can be found on the Marland Department of Health site under the FY 2011 Transmittals page at this link.
