In 2015, the state of New Mexico altered their State Plan under Title XIX of the Social Security Act (SSSA) to include hospice care that would be provided in accordance with section 1905(o) of the SSA, which would also be in accordance with section 2302 of the Affordable Care Act. The document also includes a supplementary document about hospice care, which indicates that a children under age 21 is not required to waive Medicaid payment for curative treatment upon the election of hospice benefit.
