In February 2011, the State of New Hampshire began to offer individuals under age 21 the ability to elect for hospice treatment without the need to forego curative treatment. This revision was filed by the Office of Legislative Services under Chapter HE-W 400, which governs the Medical Assistance Program. Section He-W 544.02 (b)(3) states, “To be eligible to receive hospice care, recipients under the age of 12: Shall not, in accordance with 42 U.S.C. 1396d(o)(1), be required to waive rights to Title XIX services that are related to treatment of the recipient’s diagnosis of terminal illness has been made.
